Terms of Use

Applies to: NOMS on iOS (App Store) and Android (Google Play)

1. Intellectual Property

The NOMS application, including its design, source code, and unique features like Physics Box and Visual Clusters, are the intellectual property of the developer. You may not decompile or copy any part of the app.

2. NOMS PRO Subscriptions

NOMS PRO offers premium features via auto-renewable subscriptions.

• Payments are charged to your Apple ID account (on iOS) or Google Play account (on Android) at confirmation.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• You can manage or cancel your subscription in your App Store Account Settings (iOS) or Google Play subscription settings (Android).
• Subscription status is verified through RevenueCat Inc., a third-party service.
• NOMS PRO is also available as a one-time lifetime purchase, which grants permanent access to all PRO features without recurring charges.

3. AI Nutrition Estimation

• Estimates only: AI-generated nutritional values (calories, carbs, protein, fat) are approximate estimates produced by a third-party AI model. They are not verified by a dietitian, nutritionist, or medical professional and should not be treated as accurate or definitive.
• Not medical or dietary advice: NOMS does not provide medical, nutritional, or dietary advice. The AI estimates are intended for general informational and journaling purposes only. Do not rely on them for medical decisions, dietary planning for health conditions, or any situation requiring professional guidance.
• Your responsibility: You are responsible for verifying nutritional information if accuracy is important to you. NOMS encourages you to review and adjust AI-generated values before saving.
• Third-party processing: This feature requires sending your food photo to Groq Inc., a third-party AI service, for analysis. By consenting to use this feature in the app, you agree to this data transmission. See our Privacy Policy for full details.
• Availability: The AI estimation feature depends on a third-party service and may be unavailable, interrupted, or discontinued at any time without notice. NOMS is not liable for any downtime or changes to this feature.

4. Peek Social Feature

• Account required: Peek requires authentication via Sign in with Apple (on iOS) or Google Sign-In (on Android). By signing in, you agree to create a Peek profile that is visible to your friends.
• Shared content: When you share a food entry to Peek, it becomes visible to your accepted friends. You are responsible for the content you share. Do not share content that is offensive, illegal, or violates the rights of others.
• Temporary visibility: Shared food entries are visible for a limited period (up to 2 days for free users) and are then automatically deleted from the server. This is by design and is not a malfunction.
• No guarantee of availability: Peek depends on external server infrastructure and may be unavailable, modified, or discontinued at any time without notice.
• Reporting and blocking: You may report inappropriate content or block other users. We reserve the right to remove content or suspend accounts that violate these terms.
• Account deletion: You can delete your Peek account at any time from within the app. Deletion is permanent and removes all your Peek data from our servers.

5. Acceptable Use

When using NOMS and its social features, you agree not to:

• Share content that is offensive, abusive, harassing, or illegal.
• Impersonate another person or misrepresent your identity.
• Attempt to access other users’ data or accounts without authorization.
• Use the app or its features for any commercial purpose not intended by the developer.
• Interfere with or disrupt the app’s services or servers.

We reserve the right to suspend or terminate access to Peek or the entire app for users who violate these terms.

6. Advertisements

NOMS displays advertisements to free users within certain areas of the app. Advertisements are served by Google AdMob. By using the free version of NOMS, you agree to the display of advertisements.

NOMS also offers optional rewarded video advertisements. Watching a rewarded ad is always your choice and provides temporary in-app benefits (such as a 24-hour skin trial). Rewarded ads are never forced upon you.

PRO subscribers do not see any advertisements.

7. Account & Data Deletion

You have the right to delete your account and data:

• Local data: You can delete all data from within the app via Settings → Delete All Data. Alternatively, uninstalling the app removes all local data from your device.
• Peek account: You can delete your Peek account from within the app (Profile → Delete Peek Account). This permanently and irreversibly removes your profile, shared entries, photos, reactions, and friend connections from our servers.
• Cloud data: On iOS, data synced to iCloud can be managed through your device’s iCloud storage settings. On Android, all data is stored locally and removed when the app is uninstalled or when you use the in-app deletion option.

8. Disclaimers

NOMS is a tool for journaling and personal organization. We do not provide nutritional, medical, or financial advice. We are not responsible for any decisions made based on the data tracked or estimated within the app, including AI-generated nutritional estimates.

THE APP AND ALL FEATURES, INCLUDING AI NUTRITION ESTIMATION, PEEK SOCIAL FEATURES, AND ADVERTISEMENTS, ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

9. Limitation of Liability

To the maximum extent permitted by applicable law, the developer of NOMS shall not be liable for any indirect, incidental, or consequential damages arising from your use of the app or reliance on any data or estimates provided by the app, including AI-generated nutritional information, social interactions through Peek, or any content displayed through advertisements.

10. Changes to These Terms

We may update these Terms of Use from time to time. Any changes will be reflected on this page with an updated “Last updated” date. Continued use of NOMS after changes constitutes acceptance of the revised terms.
